Zoning, Planning & Land Use Attorney

Attorneys who work with real estate issues which involve zoning, planning, and land use controls are vital to a community's development, growth, and harmony.  The development of a new shopping mall, the enforcement of a city's zoning laws, or the taking of one's property through eminent domain are just a few of the common legal issues in which these attorneys are skilled.

A zoning, planning, and land use attorney may be contacted for any of the below issues that arise, any matters related to one's full enjoyment of his or her property, or any development and zoning questions that one may have.  This area of the law is often difficult for individuals to fully understand, as there is no uniformity from one town to the next.  If you have questions, contact a local attorney skilled in these matters.

Zoning, Planning & Land Use Issues

  • Nuisances;
  • Eminent domain issues;
  • Enforcement of zoning laws (i.e. Non-conforming use of one's property);
  • Re-zoning an area (i.e. Converting a mainly residential area to allow a convenience store);
  • Lawsuits involving violations of the Fair Housing Act and other federal or state laws protecting individuals against discrimination;
  • Planning and developing new areas in a city or county (i.e. Researching, advising, and overseeing the legalities involved in a new downtown construction project);
  • Assisting developers in their planned unit development (PUD) projects;
  • Enforcing or obtaining restrictive uses of land, such as an easement.

Land Use Planning Laws

Land use planning laws differ from state to state, county to county, and even city to city.  Most cities have a general plan, and zone areas within them accordingly.  A factory doesn't generally get placed in the middle of a residential neighborhood, and a strip club doesn't normally open up next to an elementary school.

The laws and zoning put in place, a city's planning officials, and the attorneys enforcing these laws are largely responsible for ensuring that these situations do not occur.  It is important to learn the zoning laws for your area or municipality.  Contact a local, skilled zoning, planning, and land use attorney to determine your needs and rights.
