Tax Law Attorneys

A tax law attorney has tremendous job responsibilities in today's environment.  Constantly changing tax laws, coupled with aggressive collection methods by the IRS, helps ensure that tax attorneys are not short on work.  Thus, many tax attorneys attain more education than the average lawyer. 

In order to develop a very specific concentration in tax law, a tax law attorney will often also have a CPA license, and/or an LLM degree focusing on tax, after earning his or her Juris Doctor degree.

Common Tax Attorney Issues

  • Estate planning strategies to minimize both state and federal estate taxes at one's death.
  • Handling probated estates/executorships and settling tax issues with the IRS.
  • Dealing with the IRS on tax audits and debt settlements for unpaid taxes.
  • Stopping the IRS from issuing a levy on one's property for collections.
  • Setting up proper business structures for individuals and companies concerned about taxable income.
  • Defending individuals against the IRS for cases involving tax fraud and other illegal behavior.
  • Finding tax benefits that the IRS makes available, while not exceeding the limits of the law. (If you think that you have found a "loophole" on your own that sounds too good to be true, odds are that it often is, and the IRS has likely closed it up. Thus, one may want to first ask a tax law attorney.)

What else to Tax Attorneys do?

Tax attorneys are generally well versed in all aspects of the law involving tax issues.  Not only are they hired for issues that are transactional in nature, but it is also not uncommon for them to litigate claims on one's behalf.  This often occurs in disputed matters with the IRS.

Tax attorneys also must stay on top of constantly changing tax laws.  The Internal Revenue Code is the material with which a skilled tax attorney should be very knowledgeable.  Keeping abreast of constant revenue rulings by the IRS and decisions handed down from the U.S. Tax Court is equally important as knowing the Code.  Although attorneys must be careful in most states by advertising that they are a specialist in a certain area of the law, many tax attorneys are usually very skilled and have developed a very specific career focused on tax issues.  If you are unsure exactly what to do with a current tax issue, then a local tax attorney may be able to help.
