In recent years, there have been several securities law cases of large-scale fraud, severe mismanagement of funds, and general negligence, costing investors billions of dollars.  One does not have to be the victim of a high profile scam or a party to a massive class action lawsuit to recover damages for an injury suffered at the hands of his or her investment advisor.

A securities lawyer is often used for litigation by individuals who have suffered damages at the hands of an investment advisor.  However, simply the loss of money in an investment usually will not suffice.  When a valid claim exists, losses are often accompanied by some form of misconduct, including fraud, negligence, or misrepresentation.

Securities Exchange Commission

Securities law is generally governed by federal law, including the Securities Exchange Commission (SEC).  Where federal laws do not extend, states may enact their own laws.  These strict regulations are placed upon professionals who work in the financial industry.  Not only must they be properly licensed, but when handling their clients' money, they must act within the rules and restrictions put in place by the SEC, other federal regulations, and their own state's laws.

Securities Law Issues

Securities lawyers are usually skilled in securities litigation, settlement negotiations, securities arbitration, and other forms of alternative dispute resolution.  Other situations where individuals use a securities law attorney include transactional matters, such as structuring an initial public offering, underwriting bonds, and placing common disclosure statements upon investment vehicles.
