Real Estate Attorney - Commercial

A commercial real estate attorney handles similar matters as an attorney who handles residential transactions; however, his or her day-to-day work and clients are quite different.  Commercial real estate attorneys handle legal real estate problems for borrowers and lenders, as well as other involved parties. 

When one refers to "commercial real estate," what he or she is generally referring to is property that exists to earn an income or turn a profit.  There are countless examples of commercial real estate.  Some of the most common types are outlet malls, retail stores, restaurants, skyscrapers, office complexes, gas stations, etc. 

These types of properties exist for commercial purposes, and thus, they are zoned for commercial use.  Before building a commercial property, it is often beneficial to at least meet with a commercial real estate attorney to ensure one’s commercial structure is zoned correctly, complies with the proper building codes, and that one has obtained all of the licenses necessary from the local, state, and even federal government.

Commercial Real Estate Issues

Lawyers who work in commercial real estate often work on the transactional side with their clients, including closing commercial real estate transactions for buyers and sellers, negotiating leases and purchases, modifying lease agreements, and assisting with the financing of such transactions.  Other common issues which arise include knowing how to negotiate and draft a ground lease, avoiding and advising through foreclosure, assisting through eminent domain issues, and creating plans for commercial development projects.

Commercial real estate attorneys also represent clients who have been involved in a deal that has gone bad, which may require litigation.  Some commercial realty legal disputes which require an attorney involve disputes between business partners, including the winding down/dissolution of corporate and closely-held business interests.  Other problems may arise when either a tenant or landlord attempts to get out of a lease prematurely or attempts to modify a pre-existing lease.

Real Estate Laws

Lawyers who work in commercial real estate must stay informed of state, federal, and local laws, regulations, codes, etc. Part of this duty includes staying abreast of ground-breaking cases which reshape the way business is conducted. 

If you have an issue with a landlord, tenant, builder, bank, or any other interested party involved in a commercial real estate issue or transaction, you may benefit from the services and advice of a local commercial real estate attorney.  As each state has its own statute of limitations for different legal claims, it is often more beneficial to determine your options sooner rather than later.
