An attorney skilled in handling legal malpractice cases regularly receives numerous inquiries from individuals who have lost, or been injured during, a lawsuit, and are unhappy with the way their past attorney handled the matter.  Several elements must be involved, though, for someone to successfully prove injuries resulting from legal malpractice.

Legal malpractice generally occurs due to one of three different reasons.  First, the party may have been injured resulting from the attorney's negligence.  Also, the attorney may have breached a fiduciary duty owed to the client.  Finally, the attorney may have breached a contract he or she had with the client.

  • Failed to take action before the statute of limitations passed;
  • Negotiates and settles a claim without client's consent;
  • Does not abide by the terms of the contract made with the client;

  • Other general breach of his or her fiduciary duty.

Recovering Malpractice Damages

Legal malpractice attorneys will handle your claim against your former lawyer, if they agree that you have a claim.  You must be able to prove that you suffered damages due to the past attorney's actions or inactions.  Just because the attorney's losing strategy did not work out for you, this does not necessarily mean you have a claim.
