Juvenile Attorney

A juvenile attorney practices in an area of the law that is quite different from most other areas of the law.  Issues dealing with minors under the age of 18 are handled in their own court, which is called juvenile court.

Juvenile court differs from civil and criminal courts for adults in that the sole decider is the judge presiding over the case.  A jury does not participate in these proceedings.  There can be exceptions, such as a murder trial trying a juvenile as an adult; a jury would be the decider in this case.  

Minors' Rights

Certain issues are unique to juveniles, such as searching juveniles in schools, delinquency proceedings, and school drug testing.  These incidents must still be performed properly, and they must be done under a certain reasonableness standard.  A juvenile attorney can assist in describing the proper standards and showing case law that better explains these standards.

Your minor child is allowed to have a parental presence for his or her dealings with the police.  Furthermore, he or she is entitled to the same rights as an adult, such as assistance of counsel.  However, many of the same procedures as an adult also apply, including search incident to custody, identification procedures, interrogation, and detention, to name a few.  

Juvenile's Punishments

Juveniles may be treated as and confined as a criminal.  However, you should still consult an attorney to ensure that your child is being treated as he or she should.  Minors are entitled to ask for bail, to be detained properly, and to be confined under certain proper conditions.  An experienced juvenile attorney is generally well adept and better at assisting you through this difficult period.

Often times, a minor's record can be expunged through good behavior, with a combination of probation, community service, and/or monetary fines.  If your child has been arrested, for whatever reason, it is usually wise to consult with a skilled juvenile attorney to best determine your child’s options.
