Divorce Attorney

A divorce attorney is an attorney who practices within a particular area of family law.  A divorce is a legal proceeding that officially terminates a marriage.  There are many different legal reasons for a divorce, as well as alternatives to divorce.  A local divorce law attorney should be contacted if you want to file divorce or if your spouse has served you with divorce papers.

Other options include an annulment, where applicable, as well as ADR methods.  ADR, alternative dispute resolution, is just that, an alternative means for settling a dispute.  The two most common ADR methods are arbitration & mediation.  These methods can be cheaper and quicker than traditional legal methods.

State Specific Divorce Laws

Divorce laws differ, depending upon the state in which one resides.  Each state has its own definition of what constitutes a no-fault divorce and a fault based divorce.  Furthermore, laws and procedures typically even vary from county to county as well.  A fault based divorce often ends less amicably than a no-fault divorce because one party alleges that the other has done some form of wrong to the other, such as having an extramarital affair.

Also, each state's property laws (community property state / separate property state) will affect how assets are divided among the couple.  A divorce attorney must be skilled in all aspects of the applicable law.  Other correlated matters to one's divorce include alimony, child support, custody issues, visitation rights, etc.  These issues are typically ironed out in the marital dissolution agreement.

Divorce Counselor

A good divorce attorney is more than just an attorney.  He or she must also be empathetic to one's marital problems.  While a divorce is a legal dissolution of a marriage, many other critical factors often considered are the emotional and spiritual aspects of one’s decision, as well as the long-lasting strains it can have on one’s family.

Thus, it is beneficial for a divorce law attorney to not only be very knowledgeable of the law, but to also be a good listener, counselor, and friend.  If you have been served divorce papers, or if you have decided to file for one, then a divorce attorney can assist you when determining your options, as well as finding potential alternatives.
