Class Action Attorney

A class action attorney can be extremely helpful to individuals who have been harmed or wronged by a large corporation, or an individual, but do not know where to begin the legal process.  In these cases, attorneys often assist in adjoining other plaintiffs to the lawsuit and forming the class action, if appropriate.

If you have received documentation notifying you that you have been included in a class action lawsuit, it should answer many of your class action questions.  However, one could benefit greatly by consulting with an attorney who is experienced in handling class action suits, as well as one who is experienced in opting out of class action suits.  

Class Action Benefits

A class action lawsuit is an easier, quicker, and less expensive way for defendant companies, persons, etc. to deal with large numbers of people who claim that they have been injured.  The courts often prefer class action lawsuits because they help prevent inconsistent outcomes resulting from several individual lawsuits litigating the same issues.

The benefits of other plaintiffs joining in a class action lawsuit are that the damages awarded are higher (because of injuries to multiple parties), the expenses per plaintiff are often much less, and a competent, high quality attorney is usually more willing to take the case. 

There are times when it is best to opt out, and there are times when it is more appropriate to stay in the class.  Before jumping into a decision to sue, not to sue, to join a class action, to form a class action, etc., having a class action attorney evaluate one’s situation can be very advantageous.  Most attorneys will advise you to check into your claim sooner rather than later.  Each type of legal claim has a statute of limitations on it, which precludes legal action after a certain period of time.

Common Class Action Questions

If you have received a class action notice in the mail, it should at least explain the following questions:

  1. Why have I been included to receive this class action notice?
  2. For what specific reason is this lawsuit being brought, and what makes it a class action? 
  3. How many members are estimated to be a part of this class?
  4. Has a settlement been reached?  If so, what is the estimated amount, and why was it reached?
  5. How do I know if I am a part of this reached settlement?
  6. Are there any exceptions that would exclude me from being a part of this class?  If so, what are they?
  7. How much will my payment be from the settlement?  How and when will I receive it?
  8. If I stay in this settlement, who are my attorneys in the matter?  How can I contact them?  How will they be paid for their services?
  9. If I stay in the class, what are my options?
  10. Why would I want to exclude myself from the settlement?  What are the consequences of doing so?
  11. Can I object to the settlement?  How do I do so?
  12. What is a settlement fairness hearing?  When and where will it occur?
  13. Do I have to be there?  Can I attend, speak, etc.?
  14. How do I obtain more information about the class action lawsuit, the settlement, etc.?
